Welcome to Sumerzé. By downloading, accessing, or using the Sumerzé mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully. If you do not agree, do not use the App.
Sumerzé is a two-sided marketplace that connects customers ("Customers") with local independent service providers ("Providers"). Sumerzé facilitates the discovery, booking, and payment of services but is not itself a service provider and does not employ Providers. Sumerzé is operated by Creamery Technologies LLC, a Colorado limited liability company ("Sumerzé", "we", "us", or "our").
You must be at least 18 years old to use Sumerzé. By creating an account you represent that you meet this requirement. Accounts created on behalf of a business must be authorized by that business.
You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us immediately at support@sumerze.com if you suspect unauthorized access. For account security issues, you may also reach us at contact@sumerze.com.
Customers may send booking requests to Providers through the App. A booking is confirmed only when the Provider explicitly accepts it. Sumerzé does not guarantee that any Provider will accept a request.
Once confirmed, both parties are expected to honor the booking. Repeated no-shows or last-minute cancellations may result in account suspension.
All payments are processed through Stripe, a third-party payment processor. By using Sumerzé's payment features you also agree to Stripe's Terms of Service.
Deposits. Providers may require a deposit at the time of booking. The deposit amount is set by the Provider and displayed before payment is submitted. Deposits are held by Sumerzé and applied toward the total cost of the service.
Final Payment. After a service is marked complete by the Provider, the Customer will receive a payment request for the remaining balance. Payment must be submitted through the App. Sumerzé charges a platform fee on each transaction; the exact fee percentage is displayed at checkout.
Tips. Customers may optionally add a tip when submitting the final payment. Tips are passed in full to the Provider and are not subject to Sumerzé's platform fee.
Discounts and frequent client rewards. Providers may offer temporary discounts and a frequent client reward (a percentage off every set number of completed visits with that Provider). Discounts and rewards are funded by the Provider, are applied automatically to the service price at booking, and the deposit and Sumerzé's fees are calculated on the discounted price. Only completed bookings count; cancelled bookings and no-shows do not. If more than one discount is available, the larger one applies; they are never combined. Rewards have no cash value, are not transferable, cannot be redeemed for money, and apply only to future bookings with the same Provider. A Provider may change or turn off their reward at any time; bookings already made keep their price. Sumerzé calculates progress in good faith from booking records and may correct calculation errors.
Quotes. A Provider may price a service at a fixed price or by quote. Requesting a quote is free and creates no obligation. A quote is the Provider's offer for the stated price, date, deposit and scope, valid until the date shown; the Provider may replace it with a new one, and only the most recent quote can be accepted. Accepting it (and paying the deposit, if any) creates a confirmed booking at that price, which does not change afterwards, governed by these Terms like any other booking, including the Provider's cancellation policy. Price ranges a Provider shows on their profile are a guide only. Reference photos you send with a request are visible only to the Provider you send it to, and you must not send images you don't have the right to share.
Payouts. Providers receive payouts directly to their connected bank account via Stripe Connect. Payout timing is subject to Stripe's standard transfer schedule. Sumerzé is not liable for delays caused by Stripe or the Provider's financial institution.
Provider Cancellations. If a Provider cancels a confirmed booking for which a deposit was collected, the deposit and the Sumerzé fee will be automatically refunded to the Customer's original payment method (the payment processing fee, which card networks do not return, is non-refundable) within 5–10 business days. The same applies if the Provider does not show up or does not respond to a request in time.
Customer Cancellations. If a Customer cancels a confirmed booking, refund eligibility is primarily determined by the Provider's stated cancellation policy, which is visible on the Provider's profile before booking. Sumerzé does not guarantee a refund for customer-initiated cancellations. However, Sumerzé reserves the right, at its sole discretion, to issue a full or partial refund to a Customer in cases of documented Provider fault — such as a Provider no-show, material misrepresentation of services, or misconduct — even where the Provider's stated policy would otherwise deny a refund. The cancellation policy applies only once the Provider has accepted the booking: if a Customer cancels a request the Provider has not yet accepted, the deposit is refunded. The booking fee is not refunded on Customer cancellations.
Disputes. If you believe a charge was made in error, contact us at billing@sumerze.com before initiating a chargeback with your bank. Filing a chargeback without first contacting us may result in account suspension. If a chargeback about a Provider's service (not provided, not as described, or canceled without a refund) is lost, the disputed amount is not returned to the Provider and a $15 dispute fee is deducted from the Provider's next payout, as described in the Provider Agreement. Sumerzé covers the fee on fraud chargebacks. To respond to a chargeback, Sumerzé sends Stripe and the bank the information about that booking, including receipts, the review and the messages between Customer and Provider (see the Privacy Policy).
Providers must complete Stripe's identity verification (Know Your Customer / KYC) before accepting payments through the App. By connecting a Stripe account, Providers also agree to the Stripe Connected Account Agreement in addition to Stripe's general Terms of Service. Providers also agree to the Sumerzé Provider Agreement (sumerze.com/provider-agreement) and the Reviews & Badges Policy (sumerze.com/reviews-and-badges), which form part of these Terms. Providers are independent contractors and are solely responsible for the quality, safety, and legality of the services they offer, including any required licenses, permits, or insurance. Providers agree not to offer services that are illegal, adult-only, or otherwise prohibited by Stripe's restricted business categories.
Licenses and permits. By listing a service, you represent and warrant that you hold, and will maintain in good standing for as long as you offer that service, every license, permit, registration, certification, and insurance policy required by federal, state, or local law to perform it in the location where you perform it. This includes, without limitation, professional and occupational licenses, food handler permits, childcare licensing, and any alcohol-related permits. If any such authorization expires, is suspended, or is revoked, you must immediately stop offering the affected service and remove or deactivate the corresponding listing. Determining what applies to you in your jurisdiction is your responsibility: Sumerzé does not advise you on it, does not verify these authorizations, and does not classify which categories require them. Sumerzé may remove listings or suspend accounts where it reasonably believes this section has been breached, but is under no obligation to monitor compliance.
Providers are responsible for their own taxes on income received through Sumerzé. Sumerzé does not withhold federal, state, or local taxes on Provider payouts. Providers who pass the IRS threshold (currently more than $20,000 and more than 200 payments in a calendar year; some states use lower amounts) will receive a Form 1099-K from Stripe, which is also reported to the IRS. Provider payouts are sent weekly, every Friday. Providers should consult a tax professional regarding their obligations, including estimated quarterly tax payments and self-employment tax.
Safety disclosure. Sumerzé does not conduct criminal background checks, license verification, or insurance verification on Providers. All Providers confirm their email address. Providers who display the Sumerzé Verified badge have also completed an identity check (Section 9), which confirms their identity but not their skills, licenses, or insurance. Customers are responsible for independently verifying Provider credentials and suitability before engaging their services.
Providers may subscribe to Sumerzé Pro for access to premium features. Subscriptions are offered on a monthly or annual basis and are processed through Apple's In-App Purchase system. A free trial may be offered to new subscribers; the trial duration is displayed before purchase. Pro Providers may appear in the Featured tab of the Discover feed, which is labeled in the app as paid placement; to appear there they must have a rating of 4.0 or higher, or no reviews yet. The order rotates and is not a recommendation by Sumerzé.
Current prices are US$14.99 per month or US$149.99 per year (or the local-currency price shown by the App Store before you confirm). Payment is charged to your Apple ID when you confirm the purchase, or at the end of any free trial. Subscriptions automatically renew at the same price and period unless cancelled at least 24 hours before the end of the current billing period, and your Apple ID is charged within 24 hours before the period ends. If a free trial is offered, it converts to a paid subscription automatically unless you cancel at least 24 hours before the trial ends; any unused part of a trial is forfeited when you buy a subscription. You can manage and cancel your subscription at any time in your device's Settings > Apple ID > Subscriptions; cancellation takes effect at the end of the current period, and you keep Pro features until then. If we change the price, Apple will notify you in advance and, where required, ask for your consent. Refunds for in-app purchases are handled by Apple under Apple's refund policies.
The Sumerzé Verified program is an optional, one-time identity verification available to all providers. By initiating verification, you agree to the following terms in addition to the rest of this agreement.
Fee. The Sumerzé Verified program requires a one-time payment of $9.99 USD (or the local-currency equivalent shown by the App Store), made as an in-app purchase through Apple's App Store when you start the process. One payment covers one verification attempt. Apple processes the payment, and refund requests are made directly to Apple (reportaproblem.apple.com) under Apple's policies; Sumerzé cannot issue refunds for App Store purchases.
Consent to identity data collection. By proceeding with Sumerzé Verified, you expressly consent to Stripe Identity (operated by Stripe, Inc.) collecting, processing, and retaining your government-issued ID document and a selfie photograph for the purpose of confirming your identity. You acknowledge that Stripe processes this data under its own privacy policy (stripe.com/privacy) and identity terms (stripe.com/legal/identity-verification).
What Sumerzé Verified means. A Sumerzé Verified badge indicates that a provider's government-issued ID was reviewed and matched to a selfie by Stripe Identity. It confirms the provider's real-world identity. It is not a background check, criminal history check, license verification, or endorsement of service quality by Sumerzé.
Badge permanence. Once granted, the Sumerzé Verified badge does not expire and does not require renewal if the provider cancels their Sumerzé Pro subscription. However, the badge is tied to the account it was granted to and is not transferable.
Account deletion. If you delete your Sumerzé account, your Sumerzé Verified status is preserved during the 30-day grace period. If you cancel the deletion within 30 days by contacting support@sumerze.com, your verified badge will be fully restored. After the grace period expires, your Sumerzé Verified status is permanently removed. The verification fee is non-refundable once the account is permanently deleted. If you create a new account in the future, you will be required to complete and pay for the verification process again.
Revocation. Sumerzé reserves the right to revoke Sumerzé Verified status if we determine that the verification was obtained fraudulently, the account engages in prohibited conduct, or if required by law. No refund will be issued upon revocation for cause. If Apple refunds the verification purchase, the Sumerzé Verified badge is removed automatically (and restored if Apple reverses the refund); to be verified again, the verification must be purchased again.
Biometric data. Sumerzé does not collect, access, store, or use any biometric identifiers or biometric information. All biometric processing is performed exclusively by Stripe. Providers in states or jurisdictions with biometric privacy laws should review Stripe's biometric data practices before proceeding.
You retain ownership of photos, bios, and other content you upload to Sumerzé ("User Content"). By uploading User Content you grant Sumerzé a non-exclusive, royalty-free, worldwide license to display and distribute that content within the App and in marketing materials. You represent that you have the right to share any content you upload.
Public visibility of Provider content. Provider profile information. Including business name, bio, city, services, reviews, and portfolio photos. Is publicly accessible. Specifically:
By uploading portfolio photos, you acknowledge and consent to this public display. You may remove individual photos at any time from Portfolio settings in the App, and you may opt out of the in-app discovery feed by toggling "Share in discovery feed" off in your Portfolio settings. Removing a photo from the App removes it from the discovery feed and your public profile page.
Zero tolerance. Sumerzé has no tolerance for objectionable content or abusive users. You can report any user or content with the in-app Report button and block any user from their profile, a booking or a chat; once blocked, neither of you can message or book the other. We review reports within 24 hours of receiving them and, where appropriate, remove the content and suspend or remove the account of the user who posted it.
Sumerzé may suspend or terminate your account at any time for violation of these Terms or for any conduct that we determine, in our sole discretion, is harmful to other users or to Sumerzé. You may delete your account at any time from the Profile screen in the App.
Grace period. When you request account deletion, your account is scheduled for permanent deletion after a 30-day grace period. During this period you may contact support@sumerze.com to cancel the deletion request. After 30 days, deletion is permanent and cannot be reversed.
What is deleted. Upon permanent deletion, your profile, services, portfolio photos, booking history, and reviews are permanently removed. Messages are retained in anonymized form so the other party keeps their conversation history; your name and identity are removed from all messages.
Sumerzé Verified badge. Your Sumerzé Verified status is preserved during the 30-day grace period. If you cancel the deletion in time, your badge is fully restored. After the grace period expires, the badge is permanently removed and the one-time verification fee is non-refundable. If you create a new account, you must complete and pay for the verification process again.
Stripe payouts. If you have earnings pending transfer to your bank at the time of deletion, you should wait until after the next weekly Friday payout before deleting your account to allow Stripe to complete any outstanding transfers. Sumerzé is not responsible for funds that cannot be transferred due to early account deletion.
The App is provided "as is" without warranties of any kind. Sumerzé does not warrant that the App will be uninterrupted, error-free, or that any Provider will deliver services to your satisfaction. Use of the App is at your own risk.
Sumerzé is not liable for any delay or failure to perform its obligations under these Terms resulting from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemics, government actions or regulations, labor disputes, internet or telecommunications outages, cyberattacks, or failures of third-party services on which the App depends. Including Stripe, Apple, Supabase, or any other infrastructure or payment provider. In such events, Sumerzé's obligations are suspended for the duration of the disruption.
You agree to defend, indemnify, and hold harmless Sumerzé and its officers, directors, employees, contractors, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the App; (b) your User Content; (c) services you provide or receive through the App; (d) your violation of these Terms; or (e) your violation of any applicable law or the rights of any third party. This indemnification obligation survives termination of your account.
The App. Including its design, features, trademarks, trade dress, software, and all content created by Sumerzé. Is owned by Creamery Technologies LLC and protected by applicable intellectual property laws. The Sumerzé name and logo are trademarks of Creamery Technologies LLC. Nothing in these Terms grants you any ownership interest in, or license to use, Sumerzé's intellectual property except as expressly required to use the App for its intended purpose. You may not copy, reproduce, modify, distribute, or create derivative works of the App or its content without our prior written consent.
Sumerzé is a marketplace platform that facilitates connections between Customers and Providers. Sumerzé is not present at, and has no control over, the physical delivery of any service arranged through the App. Sumerzé is not liable for any personal injury, property damage, theft, loss, or any other harm occurring during or as a result of a service arranged through the App. All in-person services are undertaken at the sole risk of the parties involved. Customers and Providers are solely responsible for their own safety and for conducting appropriate due diligence before meeting.
Safety recommendations. Before allowing a Provider into your home or meeting a Provider or Customer in person, we strongly encourage you to: (a) review the Provider's profile, reviews, and any available verification badges; (b) communicate through the in-app messaging system before meeting so there is a record of your agreement; (c) share your location or plans with a trusted contact; and (d) independently verify any license, certification, or insurance the Provider claims to hold, as Sumerzé does not verify these. These are recommendations only. Sumerzé cannot guarantee your safety and following these steps does not create any liability for Sumerzé if harm occurs.
To the fullest extent permitted by law, Sumerzé's total liability to you for any claim arising from these Terms or your use of the App shall not exceed the greater of (a) the amount you paid to Sumerzé in the 12 months preceding the claim, or (b) $100 USD. Sumerzé is not liable for indirect, incidental, or consequential damages.
Jurisdictional variation. Some jurisdictions do not allow the exclusion or limitation of certain damages, including consequential or incidental damages or limitations on implied warranties. In such jurisdictions, our liability is limited to the greatest extent permitted by applicable law. Nothing in this section limits liability that cannot be excluded under applicable consumer protection law.
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law provisions. Any disputes not subject to arbitration under Section 20 shall be resolved exclusively in the state or federal courts located in Florida, and you consent to personal jurisdiction in those courts.
Claim limitations. Any cause of action or claim you may have arising out of or relating to these Terms or the App must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action is permanently barred, to the extent permitted by applicable law.
Please read this section carefully. It affects your legal rights.
Informal resolution first. Before filing any formal dispute, you agree to contact us at legal@sumerze.com and give us 30 days to attempt to resolve the issue informally. We aim to respond to all dispute and refund requests within 3 business days of receipt. Safety reports (submitted via the in-app Report button) are reviewed within 1 business day. These are goals, not guarantees, but we take them seriously.
Binding arbitration. If we cannot resolve a dispute informally, you and Sumerzé agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App (except as stated below) will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. Arbitration will take place in Florida or remotely if mutually agreed. The arbitrator's decision is final and may be entered as a judgment in any court of competent jurisdiction.
Class action waiver. You and Sumerzé agree that all claims must be brought in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims.
Exceptions. Either party may bring an individual claim in small claims court if it qualifies. Nothing in this section limits either party's right to seek injunctive or other equitable relief in court for intellectual property infringement or unauthorized access to the App.
Opt-out. You may opt out of arbitration within 30 days of first accepting these Terms by emailing legal@sumerze.com with the subject line "Arbitration Opt-Out" and your full name and email address. If you opt out, disputes will be resolved in the courts of Florida as set forth in Section 19.
We may update these Terms from time to time. For non-material changes — such as clarifications, formatting, or corrections that do not reduce your rights — continued use of the App after the updated Terms are posted constitutes your acceptance.
For material changes — including changes to payment terms, arbitration, liability limitations, data practices, or any change that meaningfully affects your rights or obligations. We will provide at least 30 days' advance notice by (a) sending an email to the address associated with your account, and (b) displaying a prominent in-app notice. If you do not agree to the material changes, you may close your account before they take effect. Continued use of the App after the effective date of a material change constitutes your acceptance of the updated Terms.
The date at the top of this page reflects when the Terms were last updated. We maintain a summary of significant changes below the Contact section.
Sumerzé respects intellectual property rights and complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe that content on the App infringes your copyright, please send a written notice containing all of the following to our designated DMCA agent:
DMCA Agent: Send takedown notices to legal@sumerze.com. You may also mail notices to: Sumerzé, Attn: DMCA Agent, Denver, Colorado.
Counter-notices. If you believe your content was removed by mistake or misidentification, you may submit a counter-notice to the same address. A valid counter-notice must include: your contact information; identification of the removed content and its location before removal; a statement under penalty of perjury that you have a good-faith belief the content was removed by mistake; and your consent to the jurisdiction of the federal district court for your location. Upon receipt of a valid counter-notice, we may restore the content unless the original claimant files a court action within 10 business days.
Repeat infringers will have their accounts terminated in accordance with our repeat infringer policy.
License. Subject to your compliance with these Terms, Sumerzé grants you a limited, non-exclusive, non-transferable, revocable license to access and use the App for its intended purpose of discovering, booking, and paying for local services. This license does not permit you to license, sell, rent, lease, or commercially exploit the App, build a competing service using the App, or reverse-engineer, decompile, or attempt to extract the source code of the App, except to the extent permitted by applicable law.
Modifications to the Services. We may add, change, suspend, or discontinue any feature of the App at any time, with or without notice. We will not be liable to you for any modification, suspension, or discontinuance of the Services, except as otherwise required by law.
No guaranteed support. Sumerzé is not obligated to provide any technical support or maintenance in connection with the App, although we may do so at our discretion through the support channels listed in this Agreement.
If you send us feedback, ideas, or suggestions about the App ("Feedback"), you agree that Sumerzé may use that Feedback for any purpose, including to improve the App, without any obligation to compensate you or attribute the Feedback to you. You agree not to submit Feedback that you consider confidential or proprietary, since we will treat all Feedback as non-confidential.
The App may contain links to third-party websites or content that we do not control, including Stripe, Apple, and websites linked from a Provider's profile. We are not responsible for the content, accuracy, or practices of any third-party site, and linking to a third-party site does not imply our endorsement of it. Accessing a third-party site is at your own risk and subject to that site's own terms and privacy policy.
Because Sumerzé is a marketplace that connects Customers and Providers for in-person services, you may have disputes with other users that are unrelated to Sumerzé's own conduct. To the fullest extent permitted by law, you release Sumerzé (and our officers, employees, and agents) from any claims, demands, and damages of every kind, known or unknown, arising out of or in any way connected to a dispute with another user, including disputes arising from a booking, an in-person service, or a Provider's or Customer's conduct. IF YOU ARE A CALIFORNIA RESIDENT, YOU WAIVE CALIFORNIA CIVIL CODE SECTION 1542, WHICH STATES: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY." This release is in addition to, and does not limit, the In-Person Service Disclaimer in Section 17.
